whisk-ai respects the intellectual property rights of others and expects users of Whisk.ai (the "Service") to do the same. This policy explains how to notify us of content on the Service that you believe infringes your copyright or other intellectual property rights, and how we respond.

1. Copyright notice

The Whisk.ai name, logo, site design, code, recipe text generated by our AI sous-chef, and other site content are protected by copyright, trade mark and other intellectual property laws of Australia and other countries. You may not copy, reproduce, distribute, publish, modify or create derivative works from any part of the Service without our prior written permission, except as expressly permitted by our Terms & Conditions or applicable law (such as fair dealing under the Australian Copyright Act 1968 (Cth)).

2. User-uploaded content

Users may upload recipes, photographs, notes and other material to the Service ("User Content"). Users are responsible for ensuring they own or have the rights to any User Content they upload. We do not pre-screen User Content but will respond to valid infringement notices in line with this policy.

3. How to submit an infringement notice

If you believe that material on the Service infringes your copyright or other intellectual property rights, send a written notice to our designated agent at admin@whisk-ai.ai with the subject line "Copyright infringement notice".

To be effective, your notice must include all of the following:

  1. Your full legal name, postal address, telephone number and email address.
  2. Identification of the copyrighted work or other intellectual property right you claim has been infringed (or, if multiple works, a representative list).
  3. The specific URL(s) or other location on the Service of the material you claim is infringing, with enough detail for us to locate it.
  4. A statement that you have a good-faith belief that the use of the material is not authorised by the rights holder, its agent or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or are authorised to act on the rights holder's behalf.
  6. Your physical or electronic signature.

Notices that do not contain substantially all of the above information may not be actioned. Knowingly making a material misrepresentation in an infringement notice may make you liable for damages, including costs and legal fees.

4. What happens after we receive a notice

On receipt of a valid notice we will: (a) acknowledge receipt; (b) remove or disable access to the allegedly infringing material; and (c) take reasonable steps to notify the user who uploaded it, providing them with a copy of your notice.

5. Counter-notice

If you are a user whose content has been removed and you believe it was removed in error or as a result of misidentification, you may send a counter-notice to admin@whisk-ai.ai containing:

  1. Your full legal name, postal address, telephone number and email address.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  4. Your consent to the jurisdiction of the courts of Victoria, Australia, and that you will accept service of process from the person who submitted the original notice.
  5. Your physical or electronic signature.

If we receive a valid counter-notice we may, at our discretion, restore the material unless the original complainant notifies us that they have filed legal action seeking a court order to keep the material removed.

6. Repeat infringers

We will suspend or terminate the accounts of users who are determined to be repeat infringers, and may take action against any user who we reasonably believe has uploaded infringing content.

7. Trade marks and other IP

If your complaint relates to trade marks, publicity rights or other intellectual property rather than copyright, please use the same contact address with a subject line describing the right at issue, and include analogous information to the above.
